These Terms of Use govern your access to and use of the AFARY website.

By accessing the website, purchasing a product, making a donation, submitting information, or otherwise using the website, you agree to these Terms.

1. About AFARY

Arts For At Risk Youth is a nonprofit organization supporting youth through creative expression, writing, rhythm, cultural arts, community connection, and related educational programming.

2. Permitted Use

You may use the website for lawful, personal, educational, and informational purposes.

You may not:

  • Use the website for unlawful or fraudulent activity

  • Attempt to gain unauthorized access to the website or connected accounts

  • Interfere with website security or functionality

  • Introduce viruses, malicious code, or harmful technology

  • Copy, scrape, reproduce, or distribute website content without permission

  • Impersonate AFARY or another person

  • Submit false, misleading, abusive, or harmful information

  • Use website content to exploit, harass, or endanger a minor

  • Use AFARYs name, branding, or materials without authorization

3. Youth and Parental Involvement

Purchases, donations, and legally binding submissions must be completed by an adult who is at least 18 years old or the age of legal majority in their jurisdiction.

Children and teenagers should involve a parent, guardian, educator, or authorized adult when submitting personal information or requesting enrollment in AFARY programs.

Program participation may require separate applications, releases, emergency information, parental consent, medical authorization, media consent, or additional agreements.

4. Educational and Program Information

Website content is provided for general educational and informational purposes.

AFARY programs and website materials are not substitutes for:

  • Medical care

  • Mental-health treatment

  • Crisis intervention

  • Legal advice

  • Emergency services

  • Professional diagnosis or counseling

Anyone experiencing an emergency should contact the appropriate emergency service or qualified professional.

5. Products and Purchases

Books and other products displayed on the website are subject to availability.

AFARY may:

  • Correct pricing or product-description errors

  • Limit quantities

  • Reject or cancel suspicious or unauthorized orders

  • Update products, availability, or pricing

  • Request additional information needed to complete an order

Submitting an order does not guarantee acceptance. An order is accepted when payment is approved and the order is confirmed.

6. Donations

Donations support AFARYs charitable mission and programming.

Unless a donation is accepted as expressly restricted to a particular purpose, AFARY may use the donation where it is most needed to support its mission.

Donations are generally nonrefundable, except in limited circumstances described in the Store, Shipping, Returns & Donation Policy or when required by law.

Purchasing a book or other product is not considered a charitable donation.

7. Intellectual Property

Unless otherwise stated, the website and its contents belong to AFARY or are used with permission.

Protected materials may include:

  • AFARYs name and logos

  • Written content

  • Journals and articles

  • Program materials

  • Photographs

  • Videos

  • Artwork

  • Illustrations

  • Graphics

  • Book excerpts

  • Website design and layout

You may not reproduce, publish, modify, sell, license, distribute, or commercially use these materials without written permission.

8. User Submissions

When you submit a message, testimonial, story, image, artwork, writing, or other material, you confirm that:

  • You have the right to submit it

  • It does not violate another persons rights

  • It is not unlawful, abusive, defamatory, or harmful

  • Any required parent or guardian permission has been obtained

Submission through a contact form does not automatically give AFARY permission to publicly publish a childs name, image, likeness, artwork, or personal story. Separate authorization may be required.

9. Third-Party Services

The website may use or connect with third-party platforms, including Shopify, payment providers, donation applications, fulfillment services, and external websites.

AFARY is not responsible for interruptions, errors, policies, security practices, or content controlled by third parties.

10. Disclaimer of Warranties

The website is provided on an as available basis.

To the fullest extent permitted by law, AFARY does not guarantee that:

  • The website will always be available

  • Content will be error-free

  • All features will operate without interruption

  • The website will be free from harmful components

  • Program or fundraising outcomes will meet every visitors expectations

Nothing in these Terms limits rights that cannot lawfully be waived.

11. Limitation of Liability

To the fullest extent permitted by law, AFARY and its directors, officers, employees, volunteers, contractors, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website.

This limitation does not apply where prohibited by law.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Any dispute will be handled in a court with appropriate jurisdiction over AFARYs principal place of business, unless applicable law requires otherwise.

13. Changes to These Terms

AFARY may revise these Terms periodically. Continued use of the website after revised Terms are posted constitutes acceptance of the updated Terms.
